From 1 January 2025, the new Article 167a of the Swiss Civil Procedure Code (CPC) will introduce for the first time in Switzerland professional secrecy for in-house lawyers, the scope of which will however be limited to civil proceedings. Parties and third parties to Swiss civil proceedings will have the right to refuse to cooperate and to produce documents relating to the activities of their legal department. This right has been introduced in order to eliminate certain procedural disadvantages suffered by Swiss companies involved in legal proceedings abroad, but it should also make it possible to promote exchanges with the inhouse legal department and thus strengthen its role within the company.
